Child Custody

Child Custody & Visitation Attorney

DuPage Child Custody Lawyer

One of the most challenging aspects of divorce can be child custody and visitation. In these cases, since children are involved, you need a child custody attorney who will help you resolve this matter as quickly and peacefully as possible. Whether you are going through a divorce or if you want to make changes to an existing custody arrangement, Sparrow Law is here to help you.

In child custody cases, the parent who the child resides with the most is the custodial parent and the other parent i the noncustodial parent. If there is joint custody, both parents have to work together to make any major decisions about the child(ren).

If sole custody is granted, that means the custodial parent is allowed to make all of the big child-rearing decisions without consulting the other parent. However, when the child is in the care of the parent who does not have sole custody, they are still allowed to make routine decisions when the child is in their care.

Both child custody and visitation are established based on the “best interests of the child,” under Illinois law. All of the following factors are taken into account:

- Who the child would like to be their custodial parent
- The wishes of the parent or parents for who the custodial parent should be
- The physical and mental health of all parties involved
- What the interaction and interrelationships of the child are with their parents and any siblings
- If there have been any instances of ongoing or repeated abuse
- How the child adjusts to their home, school and community
- How willing each parent is to maintain a civil relationship with the other parent and the child
