Spousal support, also known as alimony, is when one spouse provides financial support to the other spouse in a divorce. Spousal support is not part of every divorce case and is determined by many factors, which includes:
- The income and property of each parent
- The present and future earning capacity of each parent
- How long the marriage lasted
- The age and physical/emotional condition of each parent
- The standard of living each party had during the marriage
- Any impairment of present or future earning capacity that was caused by the time devoted to domestic duties or any delay of education, training, employment or career opportunities
- The time needed that will allow the parent seeking spousal support to obtain the education and training that is needed to support himself or herself
- The tax consequences of property division in the divorce
- If a prenuptial agreement was in place
- If there were any contributions or services of either spouse to the education, training or career of the other spouse
- Any other factor that the court deems just and fair
